At Hilltops Council’s February meeting, the following recommendation was passed:
a. Authorise the General Manager to request to the Minister Administering the Crown Lands Act 2016 to transfer the following Crown roads to Council control:
i. Orchard Street Young between Elizabeth Street and Taylor Road
ii. Taylor Road Young between Orchard Street and the Olympic Highway
iii. McVeigh Street Young between Spring Creek Road and Templemore Street including the intersection area of Templemore Street
iv. Petticoat Lane Young – between Wombat Street and Back Creek Road
v. Redhill Road Young – between Lot 6 DP 835263 and Fontenoy Street
vi. Fontenoy Street Young – entire length of Crown road between Henry Lawson Way and William Street
vii. Purchas Street Young – between Big Spring Creek and Thornhill Street
viii. Rowleys Road Young – between Purchas Street and Big Spring Creek
ix. Merino Road Boorowa – between Long Street and Lot 210 DP 754103
b. Authorise the General Manager to sign any documentation required to give effect to this resolution.
It has been identified that various Development Applications or access and or maintenance works are situated fronting Crown roads which are formed Crown roads maintained by Council.
At the current point in time, Council is not the owner, manager, or roads authority of these Crown roads which have been formed and maintained by Council. These roads are required to facilitate various development approval(s) which have been or will be granted by Council.
In order to provide energy infrastructure to any subdivision, it is a requirement of Essential Energy that these roads and road reserves vest in Council. Prior to Essential Energy’s electrical work for any impacted subdivision, which includes street lighting in addition to reticulated power supply and subsequent construction of the electrical works for these subdivision(s), these Crown roads need to be transferred to Council as the road authority.
As these roads have been formed and are maintained by Council it is considered appropriate that they are transferred to Council as the road authority. Without these transfers, Council would be unable to exercise full control over the roads, potentially delaying or complicating any proposed subdivision works, infrastructure upgrades, or access improvements.
